Question -What do Islamic Scholars or Muftis of shariyah say about a Muslim person who performs the funeral prayer of A Shi'aa even after knowing his belief so What is ruling on the shariya law about his faith and marital status , another situation is that he leads the funeral prayer and after that he gets to know the deceased's beliefs which clearly indicates that he was a Shi'aa so what would be the rulling regarding both the situation ?

Answer - After taking all the possibilities from the given condition it can be concluded that if the denial of the deceased person is to such an extent that he agrees with the following -divinety or infallibility of Syedna Ali Razi Allahu Anha , cursing of 1st two calliphs of Islam that is Abubakar Siddiq Radhi Allahu Anh and Umar Ibn al-Khattab Radi Allahu Anha , Accuse Ayesha Radi Allahu Anha with completely falsed allegations then a Muslim man who have none of the above belifs (have to renew their faith that is they have to recite the Shahd'ah again) and they have to renew their marriage contract as well but if the person(one who had leads his funeral od Marital rites)does not know that the deceased have such beliefs and he unknowingly participates in his funeral then there is no need to renew his faith or marital contract

وبهذا ظهران الرافضي ان كان ممن يعتقد الالوهيه في عليؓ او ان جبرائيل عليه السلام غلط في الوحي او كان ينكر صحبة الصديقؓ او يقذف السيدة الصديقةؓ فهو كافر لمخالفة القواطع المعلومة من الدين بالضرورة بخلاف ما اذا كان يفضل علياً او يسب الصحابة فانه مبتدع لا كافر كما اوضحته في كتابى تنبيه الولاة والحكام على احكام الشاتم خير الانام او احد اصحابه الكرا، وعليهم الصلاة والسلام:

الرافضي ان كان يسب الشيخينؓ ويلعنهما والعياذ بالله فهو كافر:

 Al-Fatawa al-Hindiyya (Hidayah): Volume 2, Page 264

فنقول لا يصلي على الكافر........ ولا تصل عليه لان الصلاة على الميت دعاء واستغفار والاستغفار للكافر حرام:

وشرطها سته اسلام الميت وطهارته:

ثم ان كانت نية القائل الوجه الذي يمنع التكفير فهو مسلم وان كانت نية الوجه الذي يوجب التكفير لا ينفعه فتوى المفتي ويؤمر بالتوبة والرجوع عن ذلك وبتجديد النكاح بينه وبين امراته كذا في المحيط:

ومنها ان استحلال المعصية صغيرة كانت او كبيرة كونها معصية بدلالة قطعية وكذا الاستهانة بها كفر
