Ruling on making invalid arguments about participating in condolences and the permissibility of attending condolences
Question: A person uses the hadith ("ازروۓ حدیث اکرموا اصحابی: اور و يضع من لانفس له) to justify the permissibility of c
reating and watching Tazia crowd, claiming that it is only a replication of Imam Hussain (R.A)'s mesuleum and doesn't consist any idols. He argues that just as it is allowed to look at copies of the Prophet (PBUH) 's tomb or the Kaaba, it is also allowed to look at Tazia processions.
A scholar has issued a fatwa stating that such a person is outside the fold of Sunnis and is considered a Rafzi (Shia). The scholar also ruled that the person's marriage is annulled, and they are considered a fasiq and a fajir.
Is the scholar's fatwa correct? What is the theology on creating and watching Tazia processions with this mindset?
Answer: Organizing and participating in Tazia processions, or watching them with the intention of honoring them, is a Shia practice and resembles their customs. Anyone who adopts Shia customs will be considered a Shia, even if they claim to be a Sunni. Just as wearing aa type of belt worn by non-Muslims or adopting other non-Muslim customs is considered a sign of disbelief, similarly, adopting Shia customs like Tazia proces
sions will also be considered a sign of deflection from Sunni Islam.
The hadith used to justify Tazia processions is misinterpreted and doesn't support their argument. The scholar's fatwa is correct."
