Ruling on the Marriage of a Righteous Belief Girl with a Shia who holds blasphemous (kufriya) beliefs:
Question: What do religious scholars and Muftis of Shariah say about the following issue that a girl was married on February 21, 2010, the girl is about 20 years old, this marriage was arranged through someone, in the house in which the girl was married. The marriage took place, the family presented themselves as Sayyid and Sunni, because the girl is a hafida of Sunni Hanafi Deobandi faith, and belongs to the Sadat family. Later, when the girl went to this house i.e. her in-laws, the environment there was completely different, the environment was neither religiously good nor morally, because the faith of this family came out as the faith of Shia Rafizis. They also tortured and beat the girl, and tried to impose their religion on the girl by force, but when nothing proved effective, they kicked the girl out of the house. In the light of Quran and Sunnah, Please guide, can the girl live with such a person? Is this marriage valid or not? Because it has been heard from many scholars that the marriage of Shia and Sunni is invalid in the first place.
Answer: In the above case, if the girl's husband has infidel beliefs, for example: he slanders Sayyida Ayesha Siddiqa, (رضی اللہ عنہا) or denies the companionship of Sayyidna Siddique Akbar (رضی اللہ عنہ), beliefs in the divinity of Sayidna Ali (رضی اللہ عنہ), or holds this belief about Hazrat Gabriel (علیہ السلام) that maybe he made a mistake in conveying the revelation to the Holy Prophet (ﷺ) or holds any belief that is contrary to the explicit Quran, Hadith, and definitive texts, then he is a disbeliever. The girl's marriage was not valid from the beginning, so there is no need for annulment. But if his belief is not of infidelity, rather he only insults everything, then there is a difference of opinion among the jurists. Some do takfeer (considering a disbeliever) others only consider such a fasiq (transgressor). In such a case it is better to obtain a divorce from him or to divorce her with his consent or by threatening or tempting him, and if this is not possible, the marriage should be annulled in court on the basis of the woman's Walis not being sufficient. The woman's Walis should file a claim of annulment of Nikah on the basis of absence of kuff (suitable partner).
