Regarding a woman, whose husband doesn't keep her with him, handed over to a Hindu
Question: A woman has been married for 4 years, but her husband neither divorces her nor keeps her at home. As a result, she has become homeless, and her child is also suffering. After 3 years, she went to live with another person for about 8 months. The person she was living with is willing to face punishment. Later, at a gathering, she was handed over to a Hindu. This act is considered very wrong in Islam. The president of the gathering also ordered that the person she was living with be ostracized by the community. What does Islamic law say about this situation? Should the woman remain in this state or be brought back to Islam?
Answer: In reality, pressure should be put on the woman's husband to either keep her or divorce her. It is haram for the woman to live with another man. Handing her over to a Hindu is a grave and dangerous sin. If the woman has left Islam and adopted Hinduism, it is obligatory for her to re-embrace Islam. Living in this state is haram and a major sin. If the woman is not willing to go to the Hindu, it is obligatory for the community and the president to make efforts to forcibly remove her from there and hand her over to her husband. The person who handed her over to the Hindu must publicly repent, and the person she was living with must also repent. (Jami'-ul-Fatawa, Volume: 10, Page: 63).
