Order of nikah with an apostate
It is not permissible for an apostate to marry an apostate Muslim woman or a real infidel woman, as it is stated in the Qur'an:
There are some things which are void by agreement, such as marriage with a Muslim apostate, a real unbeliever, a slave woman, or a concubine is invalid for him.
A Muslim woman who is married to someone through mistake or ignorance has an obligation to divorce him immediately to avoid adultery. And there is no need for divorce, but there is no place for divorce. When the marriage has taken place, the marriage is not done at all. There is no need for ''iddah (waiting period).'' For adultery, there is no ''iddah''.
In Dar-e-Mukhtar, it is stated that: If a non-Muslim man marries a Muslim woman and they have children, then the lineage will not be established from him, and the woman will not be required to observe the 'iddah because this marriage is invalid. And in Dar-e-Mukhtar, it is also stated that this (marriage) involves adultery which does not establish lineage.
